Parlor PERKS TERMS OF USE

Effective Date: October 1, 2024

1. Eligibility

The Parlor Perks Loyalty Program is open to eligible individuals who enroll in the program ("Members"). Participation may be limited to specific Parlor Doughnuts locations.

To be eligible for the program, you must meet the following requirements:

  • Age Requirement: You must be at least 13 years of age. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian to enroll and agree to these Terms and Conditions.

  • Residency Requirement: You must be a legal resident of the United States.

  • Valid Contact Information: You must provide a valid email address and mobile phone number during enrollment.

  • Legal Capacity: You must have the legal capacity to enter into a contract. If you are under the age of 18, your enrollment must be authorized by a parent or legal guardian.

Only natural persons are eligible to enroll in the program. Business entities, third-party aggregators, organizations, and groups are not permitted to participate in the Parlor Perks Loyalty Program.

 

2. Enrollment

Free to Join: Enrollment in the Parlor Perks Loyalty Program is free and available to all eligible individuals.

How to Enroll:

  • Download the Parlor Perks app from the Apple App Store or Google Play.

  • Provide the following required information: First and last name, a valid email address, mobile phone number, birthday, and preferred Parlor Doughnuts location.

Account Responsibility: You are responsible for all activity on your account, whether or not it was authorized by you.

Communications:

  • By enrolling, you agree to receive communications from Parlor Doughnuts via app notifications, email, or other electronic methods. These communications may include: system updates, promotions and special offers, account-related notifications, and marketing messages.

  • You may manage your communication preferences or unsubscribe from marketing emails by following the instructions within the app or in the emails themselves.

Updating Account Information:

  • You can update your account details at any time by logging into the Parlor Perks app and accessing your profile settings.

Account Limitations:

  • Each individual may only have one Parlor Perks account.

  • Using false or fictitious names to create multiple accounts is prohibited.

Right to Limit Enrollment: Parlor Doughnuts reserves the right to limit enrollment or suspend accounts that violate these terms.

Accurate Information Required:

  • You must provide true and accurate information during enrollment and keep your contact information up to date.

  • Parlor Doughnuts is not responsible for missed communications or benefits due to inaccurate information.

 

3. Earning Points

  • To earn points, members must be signed into their Parlor Perks account when placing an order through the app or online.

  • For in-store purchases, members can earn points by scanning the QR code within the app at the register when placing their order.

  • If a member forgets to use their Parlor Perks account at the time of purchase, they can still earn points by submitting the receipt via the app within 3 days of the order.

Receipt Submission:

  • Receipts can be submitted by scanning the barcode through the app. Simply select "SCAN" from the app's menu and scan the receipt’s barcode.

  • Online users can enter their receipt barcode manually by accessing their account and selecting "Earn Points."

Eligibility for Earning Points:

  • Members earn 1 point for every $1 spent on eligible purchases. Points can be earned on most food and beverage purchases, excluding alcohol, gift cards, taxes, tips, service fees, delivery fees, and surcharges.

  • Points cannot be earned on purchases made through third-party delivery services, catering orders, or transactions made on behalf of groups, organizations, or business entities.

Timeframe for Points Posting:

  • Points may take up to 24 hours to appear in a member’s account after the transaction or receipt submission.

No Points Cap:

  • There is no limit to the number of points a member can earn, though specific promotions may limit the number of points earned in a single transaction.

Expiration of Points:

  • Points will expire after 365 days of account inactivity. Any previously earned points will be forfeited after this period of inactivity.

 

4. Redeeming Points

Rewards Availability:

  • Members can redeem points for rewards such as free menu items or other items specified by Parlor Doughnuts (“Rewards”).

  • Rewards are subject to availability and may be subject to additional terms and conditions.

How to Redeem Points:

In-store Orders:

  • Members must redeem points for the desired reward via the app prior to arriving at the store.

  • To use the reward in-store, scan the QR code from the app at the register during checkout.

App Orders:

When placing an order through the Parlor Perks app, members can redeem points for available rewards during checkout by selecting from the “Offers and Rewards” section.

  • Online Orders: When placing an order via the Parlor Doughnuts website, members can redeem points for available rewards at checkout. Only available rewards will be displayed.

Using Redeemed Rewards:

Once points are redeemed, the reward will be added to the member’s account and can be used on their next purchase either in-store, through the app, or online.

  • Expiration of Redeemed Rewards: Redeemed rewards will be available for 120 minutes. If the reward is not used within this time frame, the points will be returned to the member’s account and can be redeemed again later or saved for a different reward.

Finalization of Points Usage:

  • Once an order is completed using a reward, the points associated with that reward will be removed from the member’s account.

  • Restoration of Points: Points will only be restored if Parlor Doughnuts determines, at its sole discretion, that the requested reward is unavailable or cannot be fulfilled.

Fraud Prevention:

  • Attempting to redeem points or rewards multiple times or through multiple accounts constitutes fraud. Such behavior may result in the suspension or termination of the account, in addition to other applicable actions under these terms and laws.

  • Discretion: All decisions regarding the issuance and redemption of points and rewards are subject to Parlor Doughnuts’ discretion and are final and binding on all members.

 

5. Special Offers and Promotions

  • Bonus Points: Periodically, Parlor Doughnuts will offer members the opportunity to earn bonus points through member-only promotions or challenges. These promotions may be subject to additional terms and conditions. As with regular point earning, members must identify themselves as a Parlor Perks member prior to making purchases eligible for bonus points. For more details, refer to the Earning Points section.

  • Exclusive Offers: Members may occasionally receive exclusive offers directly in their account. These offers can be redeemed as follows:

    • In the App: Exclusive offers are available in the "My Rewards and Offers" section of the app or at checkout when placing an order.

    • Online Orders: Exclusive offers will appear during checkout when placing an order through the Parlor Doughnuts website.

    • In-Store: Exclusive offers can be used by scanning the QR code in the "My Rewards and Offers" section of the app at the time of purchase.

  • Additional Terms: Some exclusive offers or promotions may be subject to additional terms, which will be specified at the time of issuance.

 

6. Referral Program

  • Referral Rewards: Parlor Perks members can earn rewards by referring friends and family to join the loyalty program. Both the referring member and the referred new member will receive $5 Parlor Cash upon the referred member’s successful enrollment and first qualifying purchase.

  • How to Refer:

    • Referring members can share their unique referral link through the Parlor Perks app.

    • The referred individual must use the referral link to download the app, enroll, and make their first qualifying purchase.

    • Only referrals that result in successful enrollments and first purchases are eligible for the reward.

  • Eligibility and Limitations:

    • Each member is eligible to refer as many individuals as they like, but the $5 Parlor Cash reward will only be issued once per referred member.

    • Referrals must be new members who have not previously signed up for the Parlor Perks program.

    • Referrals made using fake or duplicate accounts are prohibited and may result in account suspension.

  • Reward Usage:

    • Referral rewards are issued in the form of Parlor Cash and will expire 30 days after being credited to the member's account.

    • Parlor Cash can be redeemed during any in-store, online, or app purchase.

  • Additional Terms: Parlor Doughnuts reserves the right to modify or cancel the referral program at any time, as well as to disqualify any referrals that violate these terms.

 

7. Fraud Prevention

Maintaining the integrity of the Parlor Perks Loyalty Program is a priority. The following measures are in place to prevent fraudulent activity:

  • Minimum Check-in Amount: A purchase of at least $1.00 is required to earn points.

  • Scanning Limit: Customers may check in and scan receipts a maximum of 2 times per 4-hour visit period.

  • Already Scanned Receipt: Any attempt to scan a receipt that has already been used will be flagged and potentially disqualified from earning points.

  • High-Spend Transactions: Transactions exceeding $200 will be flagged for review to prevent fraud.

  • Check-in After Location Close: Users who check in more than 2 hours after their check closes will be flagged for potential fraud, as this may indicate misuse of receipts.

  • Guest-Employee Interaction: Transactions and redemptions exceeding 10 check-ins or redemptions by the same employee and guest will be flagged for potential fraud. Certain employees, such as managers, may be excluded from this rule.

  • Referral Fraud: Any attempts to earn rewards through fake or duplicate accounts, or by manipulating the referral system, may result in account suspension or termination.

  • Non-Transferability: Points, rewards, exclusive offers, or other membership benefits may not be gifted, sold, bartered, brokered, shared, or otherwise transferred. These benefits are intended for personal use only by the account holder.

 

8. Privacy and Data Security

  • Email Verification: Customers must verify their email to complete their enrollment. Verified accounts help prevent issues with invalid emails and protect customer data.

  • Data Use: Information collected through the Parlor Perks app will be used to personalize the customer experience, deliver targeted offers, and manage customer rewards. Personal data will be handled in accordance with Parlor Doughnut’s Privacy Policy.

  • Referral Program and Data Security: When referring friends or family members, no personal information is shared with other customers. All data related to referrals is securely handled by Parlor Doughnuts and is used solely for program purposes.

  • Account Deletion: Members may delete their account via the Parlor Perks app. Upon deletion, all points, rewards, and exclusive offers will be forfeited, and the account cannot be reinstated. Parlor Doughnuts will not restore points or rewards to new accounts.

 

9. Program Changes and Termination

  • Modifications: Parlor Doughnuts reserves the right to modify or update the terms and conditions of the Parlor Perks Loyalty Program, including special offers, promotions, and the referral program, at any time. Significant changes will be communicated to customers via email or app notifications.

  • Termination: In the event the Parlor Perks Loyalty Program is terminated, customers will be given advance notice to redeem any remaining points within a specified period. After this time, points and rewards will expire and be forfeited. Parlor Doughnuts reserves the right to terminate any account that abuses the program, violates terms, or engages in fraudulent activity. Upon termination or cancellation, unredeemed points, rewards, or exclusive offers will be forfeited and cannot be redeemed.

 

10. General Terms

  • Account Security: Customers are responsible for maintaining the confidentiality of their account login details. Parlor Doughnuts is not responsible for any unauthorized access to a customer's account due to their failure to protect login credentials.

  • No Cash Value: Points, rewards, and other member benefits have no cash value and are not redeemable for cash, gift certificates, or gift cards. They are promotional in nature and remain the property of Parlor Doughnuts.

  • User Conduct: Members agree to conduct themselves courteously and respectfully toward Parlor Doughnuts employees and contractors. Abusive, harassing, or threatening behavior may result in account suspension or termination.

  • Dispute Resolution: Any disputes related to the Parlor Perks Loyalty Program will be governed by the laws of Indiana, and any claims will be resolved through arbitration in accordance with the American Arbitration Association.

  • Non-Transferability: Parlor Perks accounts and any rewards earned are non-transferable and may only be used by the individual who enrolled in the program.
